Terms of Service

1. Acceptance of Terms

By accessing or using VoyaSIM's services, website, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and VoyaSIM. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Services

VoyaSIM provides electronic SIM (eSIM) services that allow users to access mobile data networks while traveling internationally. Our Services include:

  • eSIM data plans for various countries and regions
  • QR code-based eSIM activation
  • Mobile application for eSIM management
  • Customer support services

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have a compatible eSIM-enabled device
  • Provide accurate and complete registration information
  • Have the legal authority to enter into this agreement

4. Account Registration

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

5. eSIM Purchase and Activation

5.1 Purchase

When you purchase an eSIM from VoyaSIM, you are purchasing a license to use mobile data services for a specified period and data allowance. All purchases are final unless otherwise stated in our Refund Policy.

5.2 Activation

eSIM activation requires scanning the QR code provided after purchase. The validity period of your eSIM plan begins when you first connect to a supported network, not at the time of purchase.

5.3 Device Compatibility

It is your responsibility to ensure your device is eSIM-compatible and unlocked before purchase. VoyaSIM is not liable for any issues arising from device incompatibility.

6. Payment Terms

All payments are processed securely through our payment provider (Stripe). By making a purchase, you agree that:

  • You are authorized to use the payment method provided
  • All payment information is accurate and complete
  • Prices are displayed in USD unless otherwise specified
  • You are responsible for any applicable taxes

7. Data Usage and Fair Use Policy

Our eSIM plans are intended for personal, non-commercial use. We reserve the right to suspend or terminate service if we detect:

  • Excessive or abnormal data usage patterns
  • Sharing of data connection (tethering) beyond reasonable personal use
  • Use for commercial purposes without authorization
  • Any activity that violates applicable laws or regulations

8. Refund Policy

Refunds may be issued under the following conditions:

  • The eSIM has not been activated or used
  • Request is made within 30 days of purchase
  • Technical issues prevent activation (verified by our support team)

No refunds will be provided for:

  • Partially used data plans
  • Change of travel plans
  • Device incompatibility (if not verified before purchase)

9. Voyalty Cashback and Balance

Voyalty is our cashback program. When you buy an eSIM or a top-up while signed in to a VoyaSIM account, a percentage of the amount you pay by card (currently 3%, after any coupon or discount) is added to your account balance once the eSIM or top-up is issued. Referral cashback described in your account is added to the same balance.

  • Voyalty is earned on card payments (Apple Pay and Google Pay included) on our website and in the VoyaSIM app; guest checkouts, purchases billed by the App Store or Google Play and the part of an order paid with balance do not earn Voyalty
  • The balance can be applied to future card purchases from VoyaSIM; a minimum amount of each order is always paid by card
  • Voyalty is store credit: it has no cash value and cannot be withdrawn, sold or transferred to another account
  • If an order is refunded, the Voyalty earned from it is removed from your balance
  • A friend's referral code gives a discount on one order per person (account or email address), and the code's owner earns the referral cashback once for each friend
  • We may withhold or remove Voyalty obtained through fraud, abuse or errors, and we may change the Voyalty rate or end the program; balance already earned stays usable for purchases while your account is open
  • The balance is closed together with your account

10. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on our Services are the property of VoyaSIM or our licensors. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks without written authorization
  • Reverse engineer or attempt to extract source code
  • Create derivative works based on our Services

11. Limitation of Liability

To the maximum extent permitted by law, VoyaSIM shall not be liable for:

  • Network availability or quality issues beyond our control
  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Service interruptions due to force majeure events

Our total liability shall not exceed the amount you paid for the specific eSIM plan in question.

12. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

  • Uninterrupted or error-free service
  • Specific network speeds or coverage
  • Compatibility with all devices or systems

13. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, including for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment
  • Extended inactivity

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VoyaSIM is registered, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and VoyaSIM concerning our Services.
